Terms of Service Agreement

1. Acceptance of Terms

By accessing and using TapeOp Composer ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. The Service is operated by Mutation Narrative SARL, a French company.

2. Description of Service

TapeOp Composer is an AI-powered MIDI generation tool based on the Anticipatory Music Transformer model that provides:

  • AI-generated MIDI sequences and musical patterns
  • Max for Live device integration with Ableton Live
  • Cloud-based processing and generation services
  • Simple license key authentication
  • Community support through Discord

This service began as a personal project and is now being shared with the music production community.

3. User Accounts and Registration

To access certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information
  • Keep your account credentials secure and confidential
  • Accept responsibility for all activities under your account

4. Beta Program and Support

TapeOp Composer is currently in a free beta phase:

  • Beta access provides unlimited use of all features at no cost
  • We reserve the right to introduce usage limitations for accounts that exhibit abusive behavior
  • The service is currently self-funded
  • No financial commitment is required to use TapeOp Composer
  • We might welcome voluntary contributions via Patreon to help cover costs in the future

5. Beta Usage Terms

During the beta phase, usage terms are as follows:

  • All features are available for unlimited use at no cost
  • We reserve the right to limit access for accounts showing excessive or abusive usage patterns
  • Automated or bulk generation may be considered abusive use
  • Usage limitations, if applied, will be determined on a case-by-case basis
  • The service will remain free as long as server costs remain manageable
  • We'll communicate openly if changes become necessary for sustainability

We encourage reasonable use that allows all beta users to enjoy the service. Your feedback helps us understand how to grow this from a personal project into something sustainable.

6. Intellectual Property and Content

Regarding content generated through our Service:

  • You retain ownership of MIDI content you generate using the Service
  • You may use generated content for personal and commercial purposes
  • We retain ownership of our Ableton Live integration, Max for Live devices, and web platform
  • The underlying AI model (Anticipatory Music Transformer) is used under Apache License 2.0
  • You grant us a license to use your usage data to improve our services

7. Prohibited Uses and Copyright Notice

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Attempt to reverse engineer or hack our systems
  • Share your license key with others
  • Use the Service for spam or malicious activities

Important Copyright Notice: The AI model may occasionally generate content similar to existing copyrighted material. Users are responsible for verifying that generated content does not infringe on third-party copyrights before commercial use.

8. Service Availability

While we strive to maintain high availability, we do not guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance, updates, or other operational reasons.

9. Limitation of Liability

TapeOp Composer shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

10. Technology Attribution

TapeOp Composer is built on the Anticipatory Music Transformer model, developed by researchers at Stanford University and licensed under Apache License 2.0. We acknowledge and thank the original authors: John Thickstun, David Hall, Chris Donahue, and Percy Liang for their groundbreaking work in AI music generation.

11. Service Limitations

Please be aware of the following limitations during the beta phase:

  • The Service may experience occasional downtime for maintenance
  • Response times may vary based on server load
  • Features are subject to change based on community feedback
  • We cannot guarantee uninterrupted service availability

By using the beta service, you acknowledge that it is provided "as is" without warranties of any kind.

12. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of France. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Pau, France.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
